Conservatorships or Guardianships in Virginia

In every life, there comes a time when it’s just not possible to look after our own financial affairs. For this reason, the Virginia Circuit Courts facilitate legal options called guardianships and conservatorships.

A guardian may be needed when oversight is essential for health, safety, and caregiving.
A conservator may be necessary when a person has no ability to manage their own finances.
I assist clients in petitioning the court for guardianship or conservatorship for an incapacitated loved one. I also advise on the types of legal structures that are available, as well as less restrictive options that may be workable.

We start here, in the Circuit Court with jurisdiction over the place where the incapacitated person lives (or lived before entering a hospital, nursing home, or assisted living community).

My role as an attorney is to draft the petition to the court, then assist the client through the complex court process, while protect the best interests of the loved one who needs assistance. I’ll be there for the court-scheduled hearing on the need for a guardianship or conservatorship, and support the client as the court appoints a guardian or conservator.
